§ 05e · The Rental Record · LifeLog · FR

A photocopied Potomac Video rental history from 1987 beside a 2007 Facebook Beacon notice reading Preston added Lord of the Rings to his queue on Blockbuster.com, with only an x no thanks link.

The one record with its own law.

In 1987 a newspaper printed Robert Bork’s video rentals. Within fourteen months Congress made it illegal for a video shop to disclose what you rent without your written consent, given at the moment it is asked for.

In 2007 Blockbuster sent its customers’ rentals to Facebook before asking them. The settlement that cleared it paid the 3.6 million people in the class nothing.

In 2013 the law was rewritten. One click now covers every disclosure for two years. The Supreme Court heard the next case this month.
